This Privacy Policy applies to your use of the NationalDisability-Benefits.org service and any associated mobile applications or programs (together, the “Service”) provided by NationalDisability-Benefits.org(“Company,” “we,” “us” or “our”).   • Unique device identifier
  • Online identifiers, such as username and IP address
  • Interactions with our partners’ websites, e.g., what you are viewing, your interactions with certain campaigns, etc.

2. Use Of Information

We use the information we collect from you for the following purposes:

  • To provide our Service.
  • To send you marketing communications.
  • To respond to your requests and inquiries.
  • To improve user experiences by making our Service easier to use and navigate.
  • For other legitimate business purposes.

3. Sharing and Disclosure of Information

We may disclose your personal information to a third-party for a business purpose or sell your personal information (subject to your right to opt-out of those sales if you are a California consumer; see below in Section 10). When we disclose personal information for a business purpose, we enter a contract that describes the purpose and requires the recipient to both keep that personal information confidential and not use it for any purpose except performance of the contract. Our Service is not intended for children. We do not knowingly collect personal information from children, and our Service is not designed to attract children. In the event that we learn that a child under the age of 13 has provided personal information to us, we will delete such personal information as soon as possible.

When you use our Service, there may be links and you may be directed to third party websites. We are not responsible for the privacy practices or content of such other sites. If you have any questions about how these other sites use your information, you should review their policies and contact them directly.

6. Opt-Out

If you give us your cell phone number to sign-up for our text message program and would like to be unsubscribed, you may reply with the message “STOP.”  Please note you may receive more messages before your STOP request is fully processed.  Message and data rates may apply.

7. Security

We implement reasonable security measures to ensure the security of your personal information. Please understand, however, that no data transmissions over the Internet can be guaranteed to be 100% secure. Consequently, we cannot ensure or warrant the security of any information you transmit to us and you understand that any information that you transfer to us is done at your own risk. If we learn of a security systems breach we may attempt to notify you electronically so that you can take appropriate protective steps. By using our Service or otherwise providing personal information to us, you agree that we can communicate with you electronically regarding security, privacy and administrative issues relating to your use of the Service. We may post a notice via our Service or website if a security breach occurs. We may also send an email to you at the email address you have provided to us in these circumstances. Depending on where you live, you may have a legal right to receive notice of a security breach in writing.

8. International Data Transfers

We are based in the US. If you choose to provide us with information, please understand that your personal information may be transferred to the US and that we may transfer that information to our affiliates and subsidiaries or to other third parties, across borders, and from your country or jurisdiction to other countries or jurisdictions around the world. You acknowledge you understand that by providing your personal information: (i) your personal information will be used for the uses identified above in accordance with this Privacy Policy; and (ii) your personal information may be transferred to the US and other jurisdictions as indicated above, in accordance with Servicelicable law.

9. Dispute Resolution and Agreement to Arbitrate

The Dispute Resolution provisions contained in our Mobile Terms and Conditions are expressly incorporated here by reference.

10. Choice of Law

This Privacy Policy has been made in and shall be construed in accordance with the laws of the State of Florida, without giving effect to any conflict of law principles. Any disputes or claims not subject to the arbitration provision discussed above shall be resolved by a court located in Miami, Florida and you agree and submit to the exercise of personal jurisdiction of such courts for the purpose of litigating any such claim or action.

11. Assignment

In the event that all or part of our assets are sold or acquired by another party, or in the event of a merger, you grant us the right to assign the personal information collected via the Service.

12. Your California Privacy Rights

From January 1, 2020, California consumers have the following rights:

We do not sell the personal information of minors under the age of 16 without affirmative authorization.

Additionally, California Civil Code Section 1798.83 permits users who are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. Such authorized agent must be registered with the California Secretary of State. We may deny a request from an agent that does not submit proof that they have been authorized by you to act on your behalf.

We may need to confirm your verifiable consumer request before completing your request, and, for example, may ask for you to confirm data points we already have about you. We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

13. Changes to This Privacy Policy

We reserve the right to change this Privacy Policy from time to time. When we do, we will also revise the “Last Updated” date at the top. If we make material changes, we will notify you by placing a prominent notice on our Service. We encourage you to periodically review this Privacy Policy to keep up to date on how we are handling your personal information.
